The legal nature of a right to energy worldwide is explored through the interpretation of constitutional provisions, as well as other laws. The right to energy is not a human right explicitly recognized by the international legal order.

Although energy is a commodity of vital importance to human beings, it has not yet been recognised at the international level, nor has it been given a specific legal form and content.
Nevertheless, various national legal orders, at the constitutional or legislative level, have taken measures to ensure access to energy. These examples are elaborated upon in this collection, in order to allow for a holistic approach to the concept of the right to energy.

Currently in the international scientific community, the debate on energy is conducted largely based on approaches concerning energy justice, and the transition to green energy. These approaches, although interesting and valid, do not produce legally binding outcomes, and as a result, do not bind states when adopting energy and social policies. This book adds the constitutional dimension of a right to energy, coupling a moral and political issue with the law, and formulating it in such a way that it can be pursued judicially.

The book will appeal to students of constitutional and energy law, judges, researchers, and policy-makers.

Biography

Author(s):

Styliani (Stella) Christoforidou is an Adjunct Lecturer at the Hellenic Open University, Greece.

Reviews

"This book is a unique contribution in energy studies. Professor Stella Christoforidou and the contributors examine the right to energy through various lens, offering a comparative perspective on how national and regional legal frameworks receive the right to energy. The book covers a wide range of legal orders, from the European and Latin American systems to Greece and the USA. The most significant feature of this book is that it analyzes the right to energy both under a doctrinal prism, as well as by addressing its practical implications. The righters do not remain strictly within their legal profession; rather, they explore interactions with other disciplines. Their interdisciplinary approach renders the book a necessary addition to the library of everyone dealing with energy issues.The book is easy to go through, even for readers who don’t have a legal background, given that the contributors are all deemed authorities in their field of expertise and have managed to explain cutting-edge issues in a concise way. This book is a must-have for lawyers and practitioners in the field of energy studies."
- Ioanna Pervou, Assistant Professor in Public International Law at the Law Faculty, Democritus University of Thrace

//cdn.shopify.com/s/files/1/0721/0709/8154/files/a-right-to-energy-a-multilevel-constitutional-perspective_1.jpg?v=1789711214
